Information clause for the candidates regarding data processing
On the grounds of the art. 13 par. 1 and 2 of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons, dated 27 April 2016 (GDPR) please be informed that:
- Appliscale spółka z ograniczoną odpowiedzialnością seated in Krakow, address: ul. Prof. Michała Życzkowskiego 14, (31-864 ) Kraków, registered in the National Court Register under number: 0000592380, whose registry files are kept by the District Court for Kraków, XI Business Division of the National Court Register, tax number: 9452189348, REGON: 363291430 is the controller of the personal data;
- Your data shall be processed for the purposes of the recruitment process. Procession shall be lawful on the basis of the consent granted by sending your CV (art. 6 par. 1 l. a GDPR). However, if the recruitment process concerns the application for the employment contract, the procession of your data referred to in art. 221 § 1 points 1-3 of the Employment Code shall be lawful on the basis that processing is necessary for compliance with a legal obligation to which the controller is subject. Moreover, if the recruitment process concerns the application of the employment contract, compliance with a legal obligation to which the controller is subject shall be the legal basis for the procession of data referred to in art. 221 § 1 points 4-6 of the Employment Code, if procession of these data is necessary to perform work of a specified type or in a given job position (art. 6 par. 1 l. c GDPR in relation with art. 221 § 1 and 2 of the Employment Code). Procession shall also be lawful on the basis of the legitimate interests pursued by the controller such as pursuing claims and defending from them. (art. 6 par. 1 l. f GDPR). In case of consent for the processing for the purposes of the future recruitments, procession shall be lawful on the basis of consent (art. 6 par. 1 l. a GDPR).
- Your data shall be storage for the duration of recruitment process you have applied for. In case of consent for procession of personal data for the purposes of the future recruitment your data shall be storage for 3 years as of provision of the recruitment documents. Your data might be storage for the period of limitation of claims related with procession of your personal data in the recruitment process (3 years).
- You data shall be transferred to the third parties which process data by order of the Controller (e.g. IT companies) and, in case of positive result of the recruitment process, to the medical facilities to the extent mandatory to conclude an employment agreement.
- You have access to your data and you can rectify them, delete them, confine the scope of processing, claim the transmit of the data processed on the basis of consent, object the processing, in case of processing on the basis on consent withdraw the consent at any time without affecting the legality of the processing which took place before the withdrawal.
- You have a right to submit a complain to the President of the Data Protection office.
- You data may be transferred to the third country (USA) due to transfer of data to the parties which process data by order of the Controller (e.g. IT companies). Moreover, your data may be transferred to the third country (USA) if it is necessary due to the agreements concluded by the Processor. Your data shall be protected properly due to the fact that European Commission confirmed the relevant standard of protection in COMMISSION IMPLEMENTING DECISION (EU) 2023/1795 of 10 July 2023 pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council.
